Deposit: A Deposit equal to Forty Percent (40%) of the Rental Fee, which includes the reservation fees, cleaning fee and taxes, is due and payable upon execution of this Rental Agreement to confirm the reservation, unless a special promotion dictates otherwise. Reservations made less than sixty days prior to the scheduled date of arrival will require payment in full at time of booking. The Deposit can be paid by credit card (Visa, Discover, Mastercard or American Express). Rental deposits are held in Agent’s FDIC-insured interest-bearing escrow account and Rental Guest hereby agrees the interest will accrue to the benefit of Agent.
Balance: The remaining balance of the Rental Fee must be paid by credit card (American Express, Visa, Master Card, Discover) at least sixty(60) days prior to the Arrival Date.
Rates: Published rental rates are subject to change without notice. We reserve the right to correct rates that may have been misquoted due to human and/or computer error.
Gate Passes: Rental properties in Sea Pines and Palmetto Dunes require a car pass per vehicle to enter the communities. For your convenience, Agent will secure the pass(es). The car pass fee(s) including tax will be added to the final balance due prior to arrival. The maximum number of passes may not exceed the approved number of parking spaces available for the specific property.
Prohibited Vehicles: Trailers, UHaul’s, Motor Homes, Motorcycles and/or Commercial or Recreational Vehicles are prohibited in the gated communities. No watercraft, trailers (boat, jet skis, etc) are allowed into the gated communities without prior arrangements and/or approval by the community HOA. Parking is not allowed on streets and landscaped areas (vehicles are subject to being ticketed or towed at the discretion of local authorities).

Property Availability: Relax Rentals reserves the right to change, alter or move renters to another property if necessary due to unforeseen circumstances. Relax Rentals is not responsible for acts of Mother Nature, including weather, beach conditions, etc. Should a property become unavailable for guest use through the sale of the premises or other circumstances beyond the reasonable control of the rental agent, the agent may substitute with the best available, comparable accommodations for the same period.
Check-In: Check-in time is 4:00 PM on the Arrival Date. The Premises will not be ready prior to 4:00 PM and use of the Premises or its amenities, including parking or storage of luggage, is not allowed prior to check-in. Agent will make every effort to ensure the Premises are cleaned and ready for occupancy by 4PM, but it is not guaranteed. After hours check-ins can be accommodated with prior notice.
Check-out: The Premises must be vacated by 10 AM on the Departure Date. Please secure the Premises upon leaving and return keys (if applicable) to Agent to avoid charges for lost/missing keys. Agent’s inspection crews depend on a timely departure so they can take care of preparing for the next scheduled guests. Check-out duties include returning all furniture and accessories to their original location, washing dishes or placing them in and running the dishwasher, placing trash in outside container(s), adjusting the A/C or heating units to their original settings, closing and locking all windows and doors, and leaving the Premises in good condition for the next guest.
Lost and Found: Please be sure to do a final walk through before leaving the property. We are not responsible for any items left behind. There is a $25 min recovery charge plus shipping and handling for items left behind.
Damage Protection: The Company offers a Non-Refundable Damage Protection Policy in lieu of collecting a security deposit for the Guest’s peace of mind during their stay. The fee for the coverage is collected at the time of reservation and non-refundable. The protection plan covers the Rental Guest for up to $1,500 in accidental damage reported to Agent prior to departure. The plan does not cover damage to the Premises resulting from neglect, poor judgement, or intentional abuse. Rental Guest is responsible for the actions of all members of the rental party and invited guests. Rental Guest agrees to indemnify, defend and hold Agent and the owner of the Premises, and each of their respective affiliates, officers, employees, agents and representatives, harmless from and against any and all third party losses, liabilities, damages, actions, claims, suits, expenses and costs (including reasonable attorneys’ fees) incurred or resulting from the loss of life, personal injury and/or damage to the Premises arising from or out of the occupancy or use of the Premises by Rental Guest, the rental party or their invited guests. If damage occurs and is not reported or exceeds the $1500 coverage limit, then Rental Guest assumes liability for any loss.
Age Requirement: The Rental Guest must be at least 25 years of age to reserve the Premises and sign this Rental Agreement. The Rental Guest must be present during the entire Term of the reservation and may be required to show proof of identification.
Occupancy: The number of guests staying in the Premises is limited to the maximum occupancy listed in the Rental Agreement. Exceeding the maximum occupancy violates the terms and conditions of the Rental Agreement and may result in cancellation of the reservation and forfeiture of the Rental Fee and/or Deposit.
Quiet Hours: The Town of Hilton Head’s Short Term Rental Ordinance (Title 17, Chapter 4) states quiet hours are between 10pm-7am. We ask that you respect the ordianace and refrain from any excessive noise during this time or you may be asked to vacate the property as well as be subject to any fines/fees associated with the violation.
Use: The Premises may only be used for residential vacation accommodations. The Premises may not be used for special events, including weddings, receptions, or other large gatherings, without Agent’s prior written approval. If Agent approves a “special use request,” the Rental Guest may be required to pay an additional deposit and/or cleaning fee. Any misrepresentation by the Rental Guest could result in termination of occupancy and forfeiture of the Rental Fee and/or Deposit.
Housekeeping: We do our best to ensure all properties have been cleaned and set up properly prior to your arrival. Please note the fee you paid is for your departure clean. If upon arrival you find an inconsistency in the cleanliness please contact us immediately and we will do our best to remedy the situation. Your departure cleaning fee does not entitle you to a refund on the cleaning fee or the rental rate. Upon your departure we do expect you to leave the property in the condition you found it or risk an automatic upcharge to the card on file for excessive dirtiness.
Maintenance: Relax Rentals makes every effort to make sure the property you rented is in good working order when you arrive. If you do encounter a maintenance issue in the property, it will be handled in a timely and professional manner. Agents of the company or authorized personnel may enter the property during business hours for any purpose connected with the repair, care, or maintenance, we will do our best to notify you in advance via text message to the number listed on the reservation. We ask that you do not interfere with pre-scheduled appointments such as routine HVAC, Landscaping, and Pest Control type services as these are necessary preventative maintenance requirements on properties to keep them in the best working condition.
Supplies: Each property comes with a starter kit of kitchen amenities including dish detergent, dish soap, trash bags, and paper towels. Bathroom amenities include starter products of shampoo, conditioner, soaps, and toilet paper. These products typically last about 2 days.
Grills: Charcoal Grills are not allowed at any property per order of the Town of Hilton Head and the Town of Hilton Head Fire Department. If the rental is equipped with a gas grill, the guest assumes liability for using the grill during the rental period including guest safety as well as any potential damages to the property from use of grill.
Pet Policy: All properties are independently owned and approval of pets is at the sole discretion of the owners, as it may pose a direct threat to health and safety of the owner and their guests. Pets are not permitted in or on the Premises unless listed as a pet friendly property. All pets must be pre-approved, certain breeds and sizes of animal may not be allowed. Cats are not allowed at any property. A fee of $250 per pet is required once pet is approved, this is a non-refundable fee. Any violation of this policy will result in immediate cancellation of the reservation, forfeiture of the Rental Fee and/or Deposit and the invalidation of Agent’s Property Protection Plan so that Rental Guest will be fully responsible for any damage and required cleaning of the Premises. Pets are not permitted on furniture, must be crated when owner is not in premises and all waste must be picked up.
Pool/Spa Heat: Pool and Spa heat is available at select properties for an additional fee. This service must be requested at least two (2) weeks prior to the Arrival Date. The additional fee will be based on the time of year and fuel prices. If unforeseen mechanical problems arise, the Rental Guest will receive a credit for the unused pool heating fee. No adjustments will be made to the Rental Fee. Pools are cleaned once a week with an additional mid-week clean during the summer months. Additional cleanings may be requested and will be provided at the Rental Guest’s sole expense. Special instructions must be followed for proper operation of pool/spa combination heat. Failure to follow these instructions may result in additional fees to have pool vendor correct misuse.
Pool Waiver : I understand that all swimmers using the private pool/spa at the property I am renting do so at their own risk. All parents and/or guardians of participants in the group recognize the danger of swimming and expressly assume all risks associated with those dangers. By signing the rental agreement, I, on behalf of myself and my family, estate, and heirs, hereby release Relax Rentals, Inc and the Owners’ of the property we are renting from any liability or responsibility for any injuries or damages, whether foreseen or unforeseen, which the participant may sustain while in, or around the swimming pool area. I hereby agree to release waiver of liability concerning any and all risk of personal injury, illness, death, or property damages and verify this statement by placing my signature below.
Smoking: All our properties are non-smoking. Smoking on the premises will result in an automatic $1000 per day fee charged to the card on file.
Items out of Our Control: Relax Rentals will do everything to make your stay relaxing and enjoyable, within our means. Certain things we cannot control like the weather, temporary neighborhood outages (ie cable/internet, water, electric, appliance and equipment malfunctions, missed trash pick-ups, elevator issues and neighbor construction projects. We will do our best to remedy a situation or find an alternative solution, if and when it applies.
Hurricane Season: Hurricane Season is June 1- November 1. There is no refunds or reimbursements should a reservation be negatively affected by a hurricane, tropical storm, adverse weather or evacuation voluntarily or mandatory. By making a reservation June 1-Novemeber 1 the guest acknowledges and agrees that they are assuming the risk of a possible evacuation or incident surrounding a hurricane. Travel insurance is highly recommended.
Force Majeure : If Agent is precluded from performing any of its respective obligations under this Agreement due to strikes, lockouts, labor disputes, acts of God, inability to obtain labor or materials or reasonable substitutes therefor, governmental restrictions, regulations, or controls, judicial orders, civil authority, enemy or hostile governmental action, civil commotion, terrorist activities, epidemics, pandemics, including, without limitation the coronavirus (COVID-19) pandemic, viral or communicable disease outbreaks, quarantines, national emergencies, or other events beyond the reasonable control of the party obligated to perform (“Force Majeure Events”), the time provided for performing such obligations shall be extended by a period of time equal to the duration of the Force Majeure Event. If the Force Majeure Event continues for more than ninety (90) days, either Party may elect to immediately terminate this Rental Agreement without penalty or further obligation upon written notice to the other party.
